利用規約

本利用規約（以下「本規約」といいます。）は、中村茶舗（以下「当店」といいます。）が運営するオンラインストア（以下「当ストア」といいます。）の利用条件を定めるものです。

当ストアをご利用いただくことで、本規約に同意したものとみなします。

第1条（適用）

  1. 本規約は、商品の購入その他当ストアの利用に関する当店とお客様との間の関係に適用されます。

  2. 当ストアには、本規約のほか、プライバシーポリシー、配送ポリシー、返品・返金ポリシー、特定商取引法に基づく表示その他当店が定める各種ポリシーが適用されます。

  3. 本規約と各種ポリシーの内容が異なる場合には、当該事項について別途定められた各種ポリシーの内容を優先するものとします。

第2条（商品および価格）

  1. 商品の販売価格は、ご注文時に当ストア上に表示されている価格とします。

  2. 商品の価格、仕様、内容、パッケージ、販売期間および在庫状況等は、予告なく変更する場合があります。

  3. 商品の写真は、できる限り実際の商品に近い状態で掲載するよう努めていますが、お客様の閲覧環境や撮影条件等により、実際の商品と色合いや見え方が異なる場合があります。

第3条（ご注文）

  1. お客様は、当ストア所定の方法に従って商品を注文するものとします。

  2. 在庫切れ、価格または商品情報の誤表示、決済上の問題、配送上の問題、不正利用の疑いその他やむを得ない事情がある場合、当店はご注文の全部または一部をキャンセルさせていただく場合があります。

  3. 前項によりご注文をキャンセルし、すでに商品代金をお支払いいただいている場合には、当店所定の方法により返金いたします。

第4条（お客様情報）

  1. お客様は、ご注文その他当ストアの利用に際し、氏名、住所、電話番号、メールアドレスその他必要な情報を正確に入力するものとします。

  2. 入力内容の誤りや不足等により、商品の配送遅延、配送不能その他の問題が生じた場合、当店の責めに帰すべき場合を除き、当店はその責任を負わないものとします。

  3. 住所の入力誤り、長期不在、受取拒否その他お客様側の事情により商品が返送され、再発送、返送その他の費用が発生した場合、当店は、発送および返送に要した送料、手数料その他当店に実際に発生した費用をご負担いただく場合があります。

第5条（お支払い）

  1. ご利用いただけるお支払い方法は、国または地域により異なる場合があります。利用可能なお支払い方法は、チェックアウト画面にてご確認ください。

  2. 銀行振込、郵便振替、コンビニ決済および代金引換は、日本国内からのご注文に限りご利用いただけます。

  3. 商品代金のほか、送料、振込手数料その他必要な費用が発生する場合があります。これらについては、当ストア上の表示または各種ポリシーに従うものとします。

第6条（配送）

  1. 商品の配送方法、送料、発送時期、配送可能地域その他配送に関する条件については、当ストアの「配送ポリシー」に定めるものとします。

  2. 天候、災害、交通事情、通関手続、配送事業者の事情その他当店の合理的な管理を超える事由により、商品の発送または配送に遅延が生じる場合があります。

  3. 海外への配送については、お届け先の国または地域の法令、通関手続その他の事情により、商品の配送ができない場合や、通常より時間を要する場合があります。

  4. 海外配送に伴う関税、輸入税その他の費用については、「配送ポリシー」に定めるものとします。

第7条（キャンセル・返品・交換・返金）

  1. ご注文後のキャンセル、商品の返品、交換および返金については、当ストアの「返品・返金ポリシー」に定めるものとします。

  2. 食品および飲料については、商品の性質上、お客様のご都合による返品・交換は原則としてお受けできません。

  3. ご注文内容と異なる商品が届いた場合、商品に不良があった場合、配送中の事故等により商品が破損していた場合その他当店の責めに帰すべき事由がある場合には、「返品・返金ポリシー」に従って対応いたします。

第8条（ご注文・ご利用をお断りする場合）

当店は、お客様が以下のいずれかに該当すると合理的に判断した場合、ご注文の全部または一部の取消し、または以後のご注文をお断りする場合があります。

  1. 商品代金の支払いが確認できない場合

  2. 虚偽または不正確な情報を使用して注文した場合

  3. 不正な決済手段を使用し、またはその疑いがある場合

  4. 受取拒否や長期不在等を合理的な理由なく繰り返した場合

  5. 当店または第三者に損害を与える目的で当ストアを利用した場合

  6. 本規約その他当店が定める各種ポリシーに違反した場合

  7. その他、当店が取引を継続することが適切でないと合理的に判断した場合

第9条（禁止事項）

お客様は、当ストアの利用にあたり、以下の行為を行ってはならないものとします。

  1. 法令または公序良俗に違反する行為

  2. 虚偽の情報を登録または提供する行為

  3. 他人になりすまして当ストアを利用する行為

  4. クレジットカードその他の決済手段を不正に使用する行為

  5. 当店、他のお客様または第三者の権利または利益を侵害する行為

  6. 当ストアの運営を妨害し、またはシステムに過度な負荷を与える行為

  7. 不正アクセスその他当ストアのシステムまたはセキュリティを侵害する行為

  8. その他、当店が不適切であると合理的に判断する行為

第10条（知的財産権）

  1. 当ストアに掲載されている文章、写真、画像、動画、ロゴ、商標、デザインその他のコンテンツに関する著作権、商標権その他の知的財産権は、当店または正当な権利を有する第三者に帰属します。

  2. 法令により認められる場合を除き、当店または権利者の許可なく、これらを複製、転載、改変、配布、販売その他の方法で利用することを禁止します。

第11条（免責）

  1. 当店は、当ストアに掲載する商品情報その他の情報について、正確な内容を提供するよう努めますが、誤表示その他の誤りが判明した場合には、速やかに訂正するよう努めます。

  2. 天災、交通事情、通信障害、システム障害、配送事業者の事情、通関手続その他当店の合理的な管理を超える事由により生じた遅延、停止または損害について、当店の責めに帰すべき場合を除き、当店は責任を負わないものとします。

  3. 本規約における当店の責任を免除または制限する規定は、消費者契約法その他の法令により当該免除または制限が認められない場合には、その範囲において適用されないものとします。

第12条（個人情報の取扱い）

当店は、お客様の個人情報を、当ストアに掲載する「プライバシーポリシー」および関係法令に従って適切に取り扱います。

第13条（本規約の変更）

  1. 当店は、法令の改正、当ストアのサービス内容の変更その他必要がある場合、法令の定めに従い、本規約を変更することがあります。

  2. 変更後の本規約は、当ストア上に掲載する方法その他適切な方法によりお知らせします。

  3. 変更後の本規約は、当店が定めた効力発生日から適用されます。

第14条（準拠法および管轄）

  1. 本規約および当ストアの利用については、日本法を準拠法とします。

  2. 当ストアの利用に関して紛争が生じた場合には、当店とお客様は誠実に協議し、その解決に努めるものとします。

  3. 協議によって解決しない場合には、法令に別段の定めがある場合を除き、当店の所在地を管轄する裁判所を第一審の管轄裁判所とします。

Terms of Service

These Terms of Service (the “Terms”) set forth the terms and conditions governing the use of the online store (the “Store”) operated by Nakamura Chaho (the “Store Operator,” “we,” “us,” or “our”).

By using the Store, you agree to these Terms.

 

Article 1 (Application)

  1. These Terms apply to the relationship between you and us in connection with the purchase of products and any other use of the Store.

  2. In addition to these Terms, the Store is subject to our Privacy Policy, Shipping Policy, Return and Refund Policy, disclosures required under Japan’s Act on Specified Commercial Transactions, and other policies established by us.

  3. If there is any inconsistency between these Terms and any such policy with respect to a particular matter, the policy specifically governing that matter shall prevail.

Article 2 (Products and Prices)

  1. The selling price of a product shall be the price displayed on the Store at the time the order is placed.

  2. Product prices, specifications, contents, packaging, sales periods, availability, and other product details are subject to change without prior notice.

  3. We make reasonable efforts to display product images as accurately as possible. However, actual colors and appearance may differ from those shown on the Store due to your viewing environment, photography conditions, and other factors.

Article 3 (Orders)

  1. You shall place orders in accordance with the procedures specified by the Store.

  2. We may cancel all or part of an order in the event of insufficient inventory, an incorrect price or product description, payment or delivery issues, suspected fraudulent use, or other unavoidable circumstances.

  3. If an order is canceled pursuant to the preceding paragraph after payment has already been made, we will issue a refund in accordance with our prescribed procedures.

Article 4 (Customer Information)

  1. When placing an order or otherwise using the Store, you shall provide accurate information, including your name, address, telephone number, email address, and any other information required by the Store.

  2. We shall not be liable for delivery delays, failed deliveries, or other problems resulting from incorrect or incomplete information provided by you, except where such problems are attributable to us.

  3. If a product is returned or additional costs are incurred due to an incorrect address, extended absence, refusal to accept delivery, or other circumstances attributable to you, we may require you to reimburse us for shipping charges, return shipping charges, handling fees, and other costs actually incurred by us.

Article 5 (Payment)

  1. Available payment methods may vary depending on the country or region. Please refer to the payment options displayed at checkout.

  2. Bank transfer, postal transfer, convenience store payment, and cash on delivery are available only for orders placed within Japan.

  3. In addition to the product price, shipping charges, bank transfer fees, and other applicable costs may be incurred. Such costs shall be governed by the information displayed on the Store or the applicable policies.

Article 6 (Shipping)

  1. Shipping methods, shipping charges, shipping times, available delivery areas, and other shipping conditions shall be governed by our Shipping Policy.

  2. Shipment or delivery may be delayed due to weather, natural disasters, traffic conditions, customs procedures, circumstances affecting delivery service providers, or other events beyond our reasonable control.

  3. For international shipments, delivery may be unavailable or may take longer than usual due to the laws and regulations, customs procedures, or other circumstances of the destination country or region.

  4. Customs duties, import taxes, and other charges associated with international shipments shall be governed by our Shipping Policy.

Article 7 (Cancellations, Returns, Exchanges, and Refunds)

  1. Cancellations after an order has been placed, as well as returns, exchanges, and refunds, shall be governed by our Return and Refund Policy.

  2. Due to the nature of food and beverage products, we generally do not accept returns or exchanges for reasons attributable to the customer.

  3. If you receive an incorrect product, if a product is defective, if a product is damaged during delivery, or if another circumstance attributable to us occurs, we will handle the matter in accordance with our Return and Refund Policy.

Article 8 (Refusal of Orders or Use)

If we reasonably determine that any of the following applies, we may cancel all or part of an order or decline to accept future orders:

  1. Payment for an order cannot be confirmed;

  2. An order is placed using false or inaccurate information;

  3. A fraudulent payment method is used or suspected of being used;

  4. Delivery is repeatedly refused, or the recipient is repeatedly unavailable for delivery without reasonable cause;

  5. The Store is used for the purpose of causing damage to us or any third party;

  6. These Terms or any other policy established by us is violated; or

  7. We otherwise reasonably determine that continuing transactions would be inappropriate.

Article 9 (Prohibited Conduct)

When using the Store, you shall not engage in any of the following conduct:

  1. Conduct that violates applicable laws or public order and morals;

  2. Registering or providing false information;

  3. Using the Store while impersonating another person;

  4. Fraudulently using a credit card or other payment method;

  5. Infringing the rights or interests of us, other customers, or third parties;

  6. Interfering with the operation of the Store or placing an excessive burden on its systems;

  7. Engaging in unauthorized access or otherwise compromising the systems or security of the Store; or

  8. Any other conduct that we reasonably determine to be inappropriate.

Article 10 (Intellectual Property Rights)

  1. Copyrights, trademarks, and other intellectual property rights relating to text, photographs, images, videos, logos, trademarks, designs, and other content displayed on the Store belong to us or to third parties that legitimately hold such rights.

  2. Except as permitted by applicable law, you may not reproduce, republish, modify, distribute, sell, or otherwise use such content without our permission or the permission of the applicable rights holder.

Article 11 (Disclaimer)

  1. We make reasonable efforts to provide accurate product information and other information on the Store. If we discover an incorrect display or other error, we will endeavor to correct it promptly.

  2. Except where attributable to us, we shall not be liable for delays, interruptions, or damages resulting from natural disasters, traffic conditions, communication failures, system failures, circumstances affecting delivery service providers, customs procedures, or other events beyond our reasonable control.

  3. Any provision of these Terms that excludes or limits our liability shall not apply to the extent that such exclusion or limitation is prohibited under the Consumer Contract Act of Japan or any other applicable law.

Article 12 (Handling of Personal Information)

We will appropriately handle your personal information in accordance with our Privacy Policy displayed on the Store and applicable laws and regulations.

Article 13 (Amendments to These Terms)

  1. We may amend these Terms in accordance with applicable laws and regulations when necessary due to changes in laws and regulations, changes to the services provided by the Store, or other circumstances.

  2. We will notify you of amended Terms by posting them on the Store or by other appropriate means.

  3. The amended Terms shall take effect on the effective date specified by us.

Article 14 (Governing Law and Jurisdiction)

  1. These Terms and the use of the Store shall be governed by the laws of Japan.

  2. If any dispute arises in connection with the use of the Store, you and we shall endeavor to resolve the dispute through good-faith discussions.

  3. If the dispute cannot be resolved through such discussions, the court having jurisdiction over the location of the Store Operator shall have jurisdiction as the court of first instance, except where otherwise required by applicable law.

In the event of any inconsistency or discrepancy between the Japanese version and any translated version of these Terms, the Japanese version shall prevail to the extent permitted by applicable law.
